Lusambo asks to be cleared, says the court made a mistake in finding him guilty

Former Lusaka Province Minister, Bowman Lusambo, who is in jail, is asking the Lusaka High Court to set him free. He says the court made a mistake in finding him guilty and that the people who were supposed to prove his guilt did not do a good job.

Lusambo says the evidence used to convict him was weak and not enough. He also says that even some of the government’s own witnesses supported his side and showed he was not guilty.

Last year, on November 8, Lusambo was sentenced to four years in prison with hard labour. He was found guilty of 10 crimes including corruption, tax evasion, and owning property believed to be from crime. He had said he was not guilty.

He asked the trial court for bail while he waited for his appeal, but the court said no. Now he has taken the case to the Lusaka High Court.

In his appeal, Lusambo says the magistrate made errors in both facts and the law. He believes the judge made decisions that were not based on proper evidence.

He also says that in some parts, the court made guesses and left out important facts. He feels that the evidence, including documents and witness statements, was not looked at properly.

Lusambo’s lawyers say the court should look again at everything and use the right legal rules. They argue that the trial court was wrong and the conviction is not safe, so it should be cancelled.

They also say the prosecution did not show all the ways Lusambo could have gotten the property legally. They failed to prove that he even owned the property in question.

In the end, Lusambo and his lawyers are asking the High Court to let him go free, because the lower court made serious mistakes and the prosecution did not prove their case.
